Uses of Owen Fiss in Argentine Law. A critical approach to Communication Rights

This work uses cultural and semiotic analysis methodology to account for some uses of Owen Fiss (OF) in Argentine Law. Fiss aims to complete the First Amendment to the US Constitution, in search of a State that were more sensitive to collective interests, in order to achieve equality of opportunities of expression, not just for individuals. This debate has gained visibility due to the enactment of the Law on Audio-visual Communication Services (LSCA), as well as to the intellectual contributions of its main editor, Damian Loreti (DL).
However, both ignore the current importance of the Internet in re-shaping the media system and the field of Law, as regards freedom of expression. Accordingly, our main conclusion is that the authors´ communication theory, with its emphasis on a traditional sender denies/rejects (no reconoce/no permite) the growing contribution of all kinds of receivers in the communication process.
