The worker as compliance officer in companies, Europe and Spain

The aim of this paper is to analyse the legal regulation of the prevention system of criminal risks in the company, in Europe, and in Spain. The development of a policy of management of regulatory compliance should cover the entire business organization, since, otherwise, the company will assume criminal responsibility. Thus, the regulations of European countries such as Spain, France, Germany or Italy and also some international bodies such as the European Union, the Council of Europe, and the OECD etc. have developed compliance mechanisms. The figure of the Compliance Officer is undoubtedly called to occupy this role in the business organization chart. This figure is analysed through secondary sources, such as legislation and doctrine, the organization of the prevention systems, the functions and the responsibility assumed by both the company and the compliance officer. In addition, a comparison is made with the prevention of occupational risks in the company.
